Important: These Terms apply to users of the Site and to students/clients who engage EZmigrate for study-abroad admission services, language training, professional registration assistance, and visa application support (together, the “Services”). By accessing the Site or engaging our Services, you agree to these Terms.
2.1 We assist with profiling, shortlisting programmes and institutions, preparing and lodging applications, coordinating with Third-Party Providers, and providing general guidance.
2.2 We may provide English-language coaching (IELTS/OET/PTE) and support for professional registration pathways (e.g., nursing registrations, OSCE/CAP coordination where applicable).
2.3 No guarantee: Admission offers, registrations, visas, placements, seat availability, scholarships, and processing times are determined by the relevant Third-Party Providers and are outside our control. We do not guarantee outcomes or timelines.
2.4 Immigration advice: Where immigration advice is provided, it will be delivered by or under the supervision of a licensed immigration adviser or lawyer as required by law. Otherwise, any information we provide about visas is general in nature and not legal advice.
3.1 You warrant that all information and documents you provide are complete, accurate, current, and genuine.
3.2 You must promptly inform us of any change in circumstances (e.g., funding, health, character, study plans, contact details).
3.3 You are responsible for meeting all institutional and immigration requirements (academic, English-language, financial, health, police checks, biometrics, travel history, etc.).
3.4 You authorise us to liaise with Third-Party Providers on your behalf and to share your information as reasonably necessary to deliver the Services (see Privacy & Data below).
4.1 When you submit details via our online forms, they are routed to our team for review and follow-up. Submission does not create an obligation on us to accept you as a client. We may decline or cease Services at our discretion (e.g., non-cooperation, ineligibility, suspected misuse).
4.2 If we proceed, we will confirm the scope of work, fees, and any applicable additional terms in a Services Agreement or Letter of Engagement (“Engagement Terms"). Those Engagement Terms form part of these Terms.
5.1 Our quotations/fee schedules cover EZmigrate Service Fees only unless stated otherwise. All third-party charges (e.g., application fees, verification fees, test fees, courier/translation, immigration levies, medicals, insurance, accommodation arrangements, airport transfers) are payable by you directly to the relevant Third-Party Provider or via us as a pass-through charge.
5.2 All fees are exclusive of goods and services tax (GST) or other applicable taxes unless stated otherwise.
5.3 Invoices are due as specified in the Engagement Terms. We may suspend Services for non-payment.
6.1 Processing depends on Third-Party Providers and your timely cooperation. Delays or adverse decisions by Third-Party Providers are not our liability.
6.2 We may reasonably modify the Service plan (e.g., re-applications, deferrals, alternative institutions) subject to your instructions and any additional fees disclosed upfront.
6.3 If seat availability becomes constrained, we may recommend the next available intake or alternate institutions/programmes.
7.1 You must not misuse the Site (e.g., introduce malware, attempt unauthorised access, scrape content, or use automated means without permission).
7.2 Content on the Site is for information only and may include general guidance; you should verify critical details with official sources and your Engagement Terms.
7.3 External links are provided for convenience only; we do not endorse or control third-party content.
8.1 The Site and its contents (text, graphics, logos, media, downloads) are owned by or licensed to EZmigrate and protected by copyright and other intellectual-property laws.
8.2 You may view, and print a copy for personal use related to evaluating our Services. Any other reproduction, distribution, modification, or commercial use requires our prior written consent.
9.1 By submitting information through the Site or during our engagement, you consent to our collection, use, storage, and disclosure of your personal information for: assessing eligibility, advising on study options, preparing and lodging applications, arranging tests/registrations/accommodations/airport transfers/insurance, communicating updates, and complying with legal obligations.
9.2 We may share your data with Third-Party Providers where reasonably necessary to perform the Services, and with regulators or law-enforcement where required by law.
9.3 We take reasonable steps to safeguard your information; however, no method of transmission or storage is completely secure.
9.4 Please refer to our Privacy Policy for further details (including access/correction requests, international transfers, and retention).
This section is an extract/summary of our Refund Policy and is incorporated into these Terms. The full policy prevails in the event of any inconsistency.
10.1 Non-refundable third-party fees: Payments made to agencies/authorities such as CGFNS, Nursing Council of New Zealand, ICHC providers, Immigration NZ, licensed immigration advisers/lawyers, insurers, accommodation and airport-pickup providers are non-refundable under their rules.
10.2 Education-provider refunds: Tuition and institutional charges are subject to each provider's own refund policy.
10.3 Client responsibility: You must read and understand all Engagement Terms and refund conditions before signing or paying.
10.4 Visa rejection: If Services are interrupted due to visa rejection, we refund 50% of EZmigrate Service Fees (excl. tax), except where rejection is due to forged documents, insufficient funds, health or character issues, or insufficient supporting documents.
10.5 Offer declined for forgery/insufficient funds: No refund.
10.6 Offer deferred to next intake (e.g., seat unavailability/placement difficulty): No refund and no extra fee for deferral; we will obtain a new offer for the next available intake.
10.7 Client-initiated full withdrawal after signing: No refund; full Service Fees remain payable per the contract.
10.8 EZmigrate operational reasons: If we interrupt Services for reasons attributable to us, we refund 90% of Service Fees (excl. tax).
10.9 Admission slots unavailable (e.g., CAP/OSCE): We will try alternative institutions; if still unavailable, we refund 90% of Service Fees (excl. tax) (10% retained for administrative effort).
10.10 Refund request process: Submit a written request (preferably email). We acknowledge within 7 days and, if eligible, process within 30 days.
10.11 Discontinuation after programme start: If you discontinue with the education provider after classes commence, no refund is payable (our role for initial application/processing is considered fulfilled).
10.12 Refund of EZmigrate registration fee: Full refund of your EZmigrate registration fee (excl. tax) upon commencement of classes at the institution we enrolled you in; if visa rejection prevents commencement, we will seek the next available intake. No refund where non-attendance is for other reasons. Eligibility is assessed after 4 weeks of attendance.
10.13 Refund of English-language tuition (IELTS/OET/PTE) paid to EZmigrate: Full refund (excl. tax) once you obtain an offer letter for your preferred course and country through us, with refund eligibility after you commence and complete 4 weeks of attendance at the institution we enrolled you in.
10.14 Taxes & amendments: Any applicable taxes/levies already paid are non-refundable; the policy may be amended from time to time without prior notice.

11.1 If you believe a charge is incorrect, contact us first so we can investigate. Initiating chargebacks without giving us an opportunity to resolve may be treated as a material breach.
11.2 We may suspend or terminate Services where fees are overdue or a chargeback is raised without reasonable basis.
12.1 The Site is provided on an “as-is” and “as-available” basis. We do not warrant uninterrupted or error-free access, or that the Site will be free of viruses or other harmful components.
12.2 To the maximum extent permitted by law, we exclude all warranties and representations not expressly stated in these Terms.
12.3 To the extent permitted by the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, our liability for Services is limited to: (a) re-supplying the Services; or (b) refunding the Service Fees actually paid to EZmigrate for the part of the Services giving rise to the claim, subject to the Refunds policy above.
12.4 We are not liable for indirect, consequential, incidental, special, punitive, or exemplary losses, including loss of opportunity, profits, or data, or for outcomes determined by Third-Party Providers.
You agree to indemnify and hold EZmigrate harmless from claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of: (i) your breach of these Terms; (ii) your provision of false, misleading, or incomplete information; or (iii) your misuse of the Site or Services.
We may suspend or terminate access to the Site or Services immediately if you breach these Terms, fail to pay amounts due, or engage in conduct that risks our reputation or compliance obligations. Accrued rights and obligations (including payment and indemnity) survive termination.
We may update these Terms (and policies referenced in them) at any time by posting a revised version on the Site. Your continued use of the Site/Services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of New Zealand. You submit to the exclusive jurisdiction of the New Zealand courts. Before filing proceedings, the parties will attempt good-faith resolution within 30 days of a written notice of dispute.
